  1. What is a work permit?

It is the permission to work legally for a defined period of time for people who are not citizens of Turkey. The work permit is issued by the Ministry of Labor and Social Security.

 

  1. Why should have a work permit?

If you are working without a valid work permit in Turkey, you are violating the law and you can be punished with a criminal action and administrative fine.

 

  1. When can I apply for a work permit?

6 months from the date of registration for temporary protection.

 

  1. How can I apply for a work permit?

a) If you are an employee, your employer is required to apply for a work permit on behalf of you.

b) If you plan to start your own business, you can apply individually for an independent work permit.

 

  1. Who will be informed about the result of my work permit application and how?

The application for a work permit is submitted online made online via the e-Government website. Your employer will receive an email informing that you are allowed to work. Also, you will receive a work permit card issued by the Ministry.

 

  1. What is a work permit exemption? How can I get it?

Foreigners who work seasonal jobs in agriculture or livestock, do not need to obtain a work permit.

The work permit exemption is obtained from the Provincial Directorate of Labor and Employment Institution. When applying you need to bring with you your temporary protection ID card. The ID card needs to be issued at least 6 months prior to the application and its number needs to start with the number 99. To qualify for work permit exemption you shouldn’t have an existing valid work permit.

You can apply for work permit exemption only in the city where you have a residence.

 

  1. I have a valid work permit. Can I apply for a work permit exemption?

No. However, if your work permit is canceled, you can apply for a work permit exemption.

 

  1. Do I receive a document, if my application for exemption is accepted?

Yes, you will be notified. You can review this notification through turkiye.gov.tr and there you can print it.

 

  1. What is an employment quota? How does it work?

The number of workers, working under temporary protection in a workplace should not exceed ten (10) percent of the total number of Turkish citizens working in the same workplace. However, in those workplaces that employ no Turkish citizen or have less than ten employees in total, a maximum of one (1) foreigner under temporary protection can be granted a work permit.

 

  1. What is the employment quota if I would like to work as a seasonal worker?

The is no quota if would like to work seasonal in agriculture or livestock.

 

  1. Can I set up my own business?

Yes. You can set up your own business. In this case, you should apply yourself for an independent work permit at the Ministry of Labor and Social Security.

 

  1. What are the required documents for a work permit application?

The employer needs to apply for a work permit on behalf of you. You can’t apply independently.

  1. How should I sign a contract with an employer to get a work permit?

To apply for a work permit you need to have an employment contract with your employer. The contract needs to clearly state the nature of the job and specify ” Temporary employment contract”. You can see sample contract at the link below.

  1.  Do I need to pay a fee while applying for a work permit?

No. You do not need to pay a fee.

However, if your application is accepted, your employer will be informed if s/he should pay a fee to obtain your work permit on behalf of you.

 

  1. What is a independent work permit? How can I apply for an independent work permit?

If you would like to set up your own company, you can apply for a work permit only after you meet the following conditions:

Business licence is issued after the work permit.

 

  1. What is a prior authorization? In which cases do I need it and how can I get?

If you would like to get a work permit in some profession that requires specialization, you should first get a prior authorization from the relevant ministries.

If you do not have a prior authorization certificate, your application will not be evaluated and removed.

 

  1. What are the professions and tasks for which employment is prohibited?

 

  1. Can I work in the city I would like to?

No. You can work only in the city where you have the a right to stay. The city where you can work is written on your temporary protection ID card.

If you would like to work in a different city,first you need to apply for a change of residence.

 

  1. Is there a different salary regulation for me?

No. You should receive the same salary as Turkish citizens. You cannot be paid less than the monthly minimum wage in Turkey, which is Gross 2.029,50 TRY, Net 1.603,12 TRY

 

  1. I have a work permit. I need to go out of the city for a work. Do I need to get a permission from the Provincial Directorate of Migration Management?

Your work permit is valid only in the city where you have the right to stay. If you need to work in a different city you should obtain a permit from the Provincial Directorate of Migration Management.

 

  1. Is it sufficient to apply for a work permit through e-devlet system?

Yes. It is sufficient for your employer to make an application through the e-government about his/her desire to employ you.  There is no need to send any documents to the Ministry in paper form.

 

  1. My work permit application is rejected, what kind of rights do I have?

The Ministry of Labor and Social Security will specify why the work permit was rejected. You can re-apply if you resolve the issue which caused the rejection.

The rejection decision regarding the work permit application or renewal application will be sent to you or to your employer. You can appeal the decision within thirty (30) days from the date of notification. If the appeal is rejected, you can appeal with the administrative jurisdiction.

 

  1. What is the duration of my work permit? Does it need to be renewed?

Your work permit is valid for one year. You may apply for a renewal 60 days prior to the expiration date.

 

  1. Can I apply for a work permit to work in more than one workplace at the same time?

No, you can only apply for one workplace at a time.

 

  1.  What happens if you do not start work after you get a work permit or if you leave your job after starting work? Will my work permit be canceled?

Yes, your employer applies for cancellation of your work permit if you leave your work without notification or if you don’t show to work after you have received the work permit. The cancellation will be made through the online system by the employer.

For this reason, you have to decide well where you want to work.

 

  1. What rights do I have once I have a work permit?

You will have the same rights Turkish workers have including minumum wage, severence pay etc.

 

  1. What are my rights if I get sick or have a job accident while working in a job with a work permit?

There is no difference between a Turkish Citizen and the people who have a valid work permit. In this case, the relevant legislation applies to you as well.

 

  1. What are the national holidays and public holidays?

October 29 is a national holiday, January 1, April 23, May 1, May 19, July 15, August 30 as well as Ramadan Bairam (dates are determined each year) and Greater Eid (dates are determined each year) are considered public holidays.

1.5 day on October 29;

1 day for January 1, April 23, May 1, May 19 and August 30;

3.5 days for Ramadan Bairam

4.5 days for Greater Eid.

 

  1. Is it mandatory to work on national holidays and public holidays?

The issue of whether or not to work during the national day and public holidays will be decided in the collective agreement or in employment contracts. The employee’s consent is required if there is no provision in the collective agreement or in employment contracts.

 

  1. How will I be paid if I work on the holiday?

Working on the weekly holiday should be counted as an overtime work, as it exceeded 45-hours of the working week.

For example, when we think that Sunday is a weekly holiday and the worker is working on Sunday, this worker should receive the day’s wage without working as a weekly wage according to the Turkish Labor Act, and will earn an additional day’s wage for working on holiday, but this work is also exceeding 45 hours per week so will be paid at a rate of 50% higher, so that the worker will earn a total of two and a half days wages for a one holiday work in a week.

 

  1. I am working with a work permit, can I be a union member?

Yes, there are no impediments in being a member of the workers union if you have a work permit in Turkey.

 

Do I have to take any action if I change jobs?

Yes, the work permit will be canceled if you will quit your work. The cancellation of your work permit is completed by your employer. This cancellation has to be completed within 15 days from the end of the contract. If you want to work with a different company, your new employer needs to apply for a new work permit.

 

  1. Can I switch to another office of the same company or work temporarily in other offices of the same company?

No. Your work permit is valid only if you work at the same address that was entered into the system.  You should obtain a new work permit even if you will work in another office at the same company.

 

  1. I have applied for work permit renewal, can I continue working until the end of my work permit?

Yes, you may continue working in the same workplace and same profession without exceeding 45 days from the end date of the work permit. The work performed in this period is considered legal work and your rights, the obligations of the relevant authorities and the obligation of the employer remain the same.

 

  1. What actions will be taken against foreigners and employers who work or employ workers without a work permit?

Administrative fines are imposed on foreigners and employers who work or employ workers without a work permit.

If necessary, the expenses to return to the home country, health expenses and accommodation of the foreigner and s/his family should be covered by the employer representative who employed the foreigner without a work permit.

Administrative fines increase in case of recurring issue. Additionally, working without permission can cause the risk of deportation.

 

  1. What is ISKUR? Can I benefit from ISKUR’s courses?

Turkey Employment Agency (ISKUR) is an organization which records job seekers and helps people find jobs.

If you have had the temporary protection status for at least 6 months, you can benefit from ISKUR’s course. As part of their services, you can participate in vocational and on-the-job trainings.

 

  1. Can I participate in vocational trainings organized by ISKUR in the workplaces? Can I work at the same workplace after training?

Yes. You can benefit from ISKUR’s courses organised in a workplace as a part of active labor force services and within this scope, you can participate in vocational and on-the-job trainings. Your employer can apply to the Ministry to ensure your work at the same workplace at the end of the training period. In this application, the employment quota may apply differently by the Ministry of Labor and Social Security.
